CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL PROVISIONS

  1. By placing an order electronically through the website you are currently using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

  2. Buyers are subject to the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.

  3. Shipping fees, which constitute the product shipment costs, shall be paid by the buyers.

  4. Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

  5. The purchased product must be delivered complete, in accordance with the specifications specified in the order, and with documents such as a warranty certificate and user manual, if any.

  6. In the event that it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days from the date of learning about this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID

  1. If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ceases.

SHOPPING MADE WITH UNAUTHORIZED USE OF CREDIT CARD

  1. After the product is delivered, if it is determined that the credit card used for payment by the buyer was used unfairly by unauthorized persons and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs belonging to the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN DUE TIME DUE TO UNFORESEEN REASONS

  1. If force majeure events occur that the Seller cannot foresee and the product cannot be delivered within due time, the situation shall be notified to the Buyer. The Buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of the delivery until the obstacle is removed. If the Buyer cancels the order and has made the payment in cash, this fee shall be paid to them in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price shall be returned to the bank within 14 days from this cancellation; however, it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

THE BUYER'S OBLIGATION TO INSPECT THE PRODUCT

  1. The Buyer shall inspect the goods/services subject to the contract before receiving them; dented, broken, torn packaging, etc., damaged and defective goods/services shall not be received from the cargo company. The received goods/services shall be deemed to be undamaged and intact. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services must not be used. The Invoice must be returned together with the product.

RIGHT OF WITHDRAWAL

  1. The BUYER may exercise their right of withdrawal from the contract by rejecting the goods without assuming any legal or criminal liability and without giving any justification, within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the indicated address, provided that they notify the SELLER via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL

  1. If the purchase consists of a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the approval of the consumer before the expiry of the right of withdrawal period.

  2. The costs arising from the use of the right of withdrawal belong to the SELLER.

  3. In order to exercise the right of withdrawal, a written notification must be given to the SELLER within the 14 (fourteen) day period by registered mail, fax, or email, and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Exercised" provisions regulated in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL

  1. The invoice of the product delivered to the 3rd person or to the BUYER must be returned. (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the corporation when returning it. Order returns issued on behalf of corporations cannot be completed unless a RETURN INVOICE is issued.)

  2. The return form, the box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.

RETURN CONDITIONS

  1. The SELLER is obliged to refund the total price and the documents that put the BUYER under debt to the BUYER within 10 days at the latest from the receipt of the withdrawal notification, and to receive the goods back within 20 days.

  2. If there is a decrease in the value of the goods or if the return becomes impossible due to a reason arising from the fault of the BUYER, the BUYER is obliged to compensate the damages of the SELLER in proportion to their fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or products within the right of withdrawal period.

If you purchased the product from the Jolinbutik website:

  • Pre-Return Information:

    • No exchange transactions are made for orders placed on the website; only returns are available.

    • No exchange/return transactions can be performed at the physical store for orders placed on the website.

    • For your return to be approved, the product must be unused, unworn, unwashed, and suitable for resale.

    • After the products reach you, you can send them back within 14 business days for the return process by using the Cargo Agreement Number.

    • Shipping processes in return transactions are subject to a fee. The shipping fee for returns belongs to the buyer.

    • Please note that shipping fees will not be refunded unless an incorrect product has been delivered.

    • Perfume, bags, and accessory products are not eligible for return transactions.

    • In your return shipments, please ensure that all the products you want to return are sent in a single package.

    • You must specify the agreement number to the courier officer during return shipments.

  • Post-Return Information:

    • Your return payment is made within 1-4 business days after the products arrive at our return center. After your return is approved, an information message will be sent by our return department via WhatsApp or SMS.

    • After the refund is processed, it may take between 1-10 business days to reflect in your account, depending on your bank.

    • If the campaign limit amount set by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign shall be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

  1. Underwear bottoms, swimwear and bikini bottoms, makeup materials, disposable products, goods that are in danger of spoiling quickly or that are likely to expire, which are prepared in line with the BUYER's request or clearly personal needs and are not suitable for return, products whose packaging has been opened by the BUYER after delivery and whose return is not suitable for health and hygiene reasons, products that mix with other products after delivery and cannot be separated by their nature, goods related to periodicals such as newspapers and magazines other than those provided under a subscription agreement, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, cannot be returned as per the Regulation if their packaging has been opened by the BUYER. In addition, it is not possible to exercise the right of withdrawal regarding services whose performance has started with the approval of the consumer before the expiry of the right of withdrawal period.

  2. In order for cosmetics and personal care products, underwear products, swimwear, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs, and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untested, intact, and unused.

STATUS OF DEFAULT AND LEGAL CONSEQUENCES

  1. The BUYER accepts, declares, and undertakes that if they fall into default in cases where they make the payment transactions with a credit card, they will pay interest within the framework of the credit card agreement between the cardholder bank and themselves and will be responsible to the bank. In this case, the relevant bank may apply to legal remedies, demand the costs and attorney fees from the BUYER, and under all circumstances, if the BUYER falls into default due to their debt, the BUYER accepts that they will pay the damage and loss suffered by the SELLER due to the delayed performance of the debt.
